Treasury is seeking input on the development of changes to consent procedures and further operational enhancements to the Competition and Consumer (Consumer Data Right) Rules 2020 (the CDR Rules).

To support consultation and elicit feedback on these issues, design papers are available for stakeholders’ consideration.

Consent Review

Treasury and the Data Standards Body are exploring opportunities to simplify the CDR Rules and standards to support better consumer experiences while maintaining key consumer protections.

The design paper seeks stakeholder feedback on a number of change proposals relating to rules and standards for CDR consents. Topics for feedback include:

  • bundling of consents
  • selection of key consent terms
  • withdrawal of consent information
  • notifications
  • consents for de‑identification
  • dark patterns.

It also seeks feedback on topics for future consideration.

Operational enhancements

This design paper seeks stakeholder feedback to support the development of rules and standards to make changes to the CDR Rules so they are fit‑for‑purpose and support the policy aims of the CDR.

The design paper outlines possible changes currently under consideration. It draws on a range of sources, including submissions received in response to previous consultations about possible amendments to the CDR Rules.

The design paper is separated into two parts:

  • proposed changes to the rules of general application
  • proposed changes to the energy‑specific rules.

No changes to the other sector‑specific rules are proposed.

Stakeholder forums

To assist stakeholders to understand the proposed changes to the CDR Rules, and to provide the opportunity for discussion and feedback, Treasury will conduct stakeholder forums.

You can submit responses to this consultation up until 06 October 2023. Feedback for both design papers may be provided by email. For the Consent Review design paper, feedback can also be provided via the Consumer Data Standards Github respository.

While submissions may be lodged electronically or by post, electronic lodgement is preferred. For accessibility reasons, please submit responses sent via email in a Word or RTF format. An additional PDF version may also be submitted.
