The Government has released its response to the Independent Review of the Food and Grocery Code of Conduct, led by Professor Graeme Samuel AC.

The Government has accepted 13 of Professor Samuel’s 14 recommendations and will work with the sector to improve the Food and Grocery Code of Conduct (Code) by:

  1. enhancing the good faith obligations in the Code to make it clearer and more user friendly for the industry;
  2. strengthening the dispute resolution procedures to give suppliers more confidence in raising their complaints and having them resolved;
  3. prohibiting retailers or wholesalers from varying grocery supply agreements with retrospective effect under any circumstances;  and
  4. setting limits on acceptable conduct during price rise negotiations between the parties to restore trust and cooperation between them.

The Government will consult publicly on the changes to the Code to ensure it gives full effect to the Government’s response.
