On 16 February 2021, the Treasurer announced that Treasury would undertake an examination to ascertain whether the length of time that processes under the National Access Regime can take is appropriate and consistent with the Regime's efficiency objective.
This consultation paper seeks views on potential options to streamline and add greater certainty to decisions under the National Access Regime, including:
- reforms to the timeframe for, or availability of, merits review of Ministerial decisions on declaration or Australian Competition and Consumer Commission decisions on arbitration;
- the scope for parties to lodge repeat applications for declaration or revocation; and
- whether arbitration proceedings and determinations should cease if declaration is revoked.
Interested parties are invited to lodge submissions by 19 April 2021.
