This discussion paper was produced by the Corporations and Markets Advisory Committee. View further information about the Committee and it's other activities.

At the outset of its review, the Advisory Committee published the Referred Proposal and invited public submissions on the various initiatives suggested in it. Several submissions were received and are available online. The Committee has closely considered these submissions and has been assisted by them. The Committee has decided to issue a discussion paper at this stage and invite further submissions, given:

  • various new policy options under consideration in this paper, and
  • further perspectives on issues relevant to long-tail liabilities in consequences of the High Court decision in Sons of Gwalia Ltd v Margaretic [2007] HCA 1 (Sons of Gwalia).

The Advisory Committee would welcome further submissions from the initial respondents as well as submissions from other interested parties.
